Privacy Policy

This Privacy Policy explains how Davis Insurance and Financial Services (“TX Commercial,” “we,” “us,” or “our”) handles information collected through https://txcommercialinsurance.comand related forms, calls, texts, and emails (collectively, the “Site”). It applies to business contact and commercial risk information submitted by owners, officers, and authorized representatives of businesses.

By using the Site, you acknowledge this Policy and consent to the practices described in it, including the analytics and session recording described in Section 4. Your use of the Site is also governed by our Terms of Use. If you do not agree, do not use the Site.

Information collected in connection with an insurance transaction may also be subject to a separate privacy notice required by the Gramm-Leach-Bliley Act and applicable insurance regulations, which we provide when required.

When you request a quote, contact us, or communicate with our team, we may collect:

• Contact information — name, business name, job title, email address, telephone number, and mailing or business address.
• Business and risk information — industry, operations, city or service area, years in business, number of employees, payroll, revenue, vehicles and drivers, property and equipment, prior coverage, and loss or claims history.
• Coverage information — the coverage types you request, current carriers, policy numbers, limits, and renewal dates.
• Correspondence — the content of emails, form messages, text messages, and notes from calls with our team.

Please do not submit Social Security numbers, driver’s license numbers, financial account numbers, health information, or other sensitive personal information through the website forms. If such information is needed for underwriting, we will request it through a secure channel.

When you visit the Site, we and our service providers automatically collect:

• IP address and approximate location derived from it (typically city or region level);
• device and browser type, operating system, screen size, and language;
• referring URL, search terms where available, entry and exit pages, and pages viewed;
• dates, times, and duration of visits, and interactions such as clicks, scrolling, and form progress;
• identifiers stored in cookies, local storage, or similar technologies, including anonymous or pseudonymous visitor and session IDs; and
• marketing campaign parameters (for example, UTM tags) that indicate how you reached the Site.

PostHog, Inc. acts as our service provider and processes this information on our behalf and under our instructions. We use product analytics and session replay only for legitimate business purposes: diagnosing errors, improving usability and page performance, understanding which content and forms work, detecting fraudulent or abusive activity, and measuring the effectiveness of our marketing.

What We Do Not Record

We configure session replay to mask sensitive form inputs — including password fields and any field marked as sensitive — so their contents are not captured in the replay. We do not intentionally record payment card numbers, Social Security numbers, or credentials, and we ask that you not enter such information into the Site. Masking is a technical control and, while we make reasonable efforts to maintain it, we cannot guarantee that it captures every field in every circumstance.

Recording Is Not a Communication Interception

Session replay captures your interactions with our own website for our internal analysis. It is not used to intercept, read, or monitor any communication between you and a third party, and recordings are not sold or licensed to advertisers or data brokers.

Retention and Your Choices

Recordings and analytics events are retained for no longer than reasonably necessary for the purposes above, and then deleted or aggregated in accordance with our retention schedule and our provider’s default retention period. You can limit this collection by using your browser’s cookie controls or private browsing mode, by enabling a recognized opt-out signal such as Global Privacy Control, or by emailing us at quotes@txcommercialinsurance.com to request that we exclude and delete your recordings.

We may also use other analytics and advertising measurement services, such as Vercel Analytics and search engine or social platform tools, which collect Site usage data subject to their own privacy policies.

We use Google reCAPTCHA (v3) to protect our forms from automated abuse, spam submissions, and fraudulent lead activity. reCAPTCHA analyzes your interaction with the Site to distinguish human visitors from bots. It runs in the background and does not ask you to solve a puzzle or identify images.

To do this, reCAPTCHA collects hardware and software information — such as device and application data, IP address, browser and operating system characteristics, and mouse, touch, and keyboard behavior on the page — and sends it to Google for analysis. Google may set cookies or read existing cookies for this purpose, and may use this information to improve reCAPTCHA and its general security services.

We load reCAPTCHA only on pages that contain a form, and only once you begin interacting with that form or submit it — not simply because you visited the page. If you never interact with a form, reCAPTCHA is not loaded and this collection does not occur.

Google returns a risk score for your submission. We may retain that score, the associated action name, and the outcome of the check with our record of your submission, and we may decline, delay, or manually review submissions that appear automated. This scoring is used solely to protect the security and integrity of the Site; it is not used to make decisions about your insurance eligibility, coverage, or premium.

Your use of reCAPTCHA is subject to the Google Privacy Policy and Terms of Service. We rely on reCAPTCHA for the security and integrity of our Site. If you prefer not to use it, you may contact us instead by telephone at 214-997-3888.

We use cookies, local storage, pixels, and similar technologies to keep the Site functioning, to remember your preferences, to maintain analytics and session identifiers, and to measure marketing performance. Most browsers let you refuse or delete cookies through their settings; blocking cookies may affect how parts of the Site work.

To measure which marketing channels bring visitors to us, we store campaign parameters and advertising click identifiers (such as those added to a link by Google, Meta, Microsoft, TikTok, LinkedIn, or X when you click an ad) in your browser using first-party cookies and local storage for up to 90 days, along with the page you first arrived on and when. If you submit a form, this information is attached to your submission so we know how you found us. It is used for our own marketing measurement, is not joined with data from other websites, and is not used to serve you advertising.

We honor the Global Privacy Control (GPC) and similar recognized universal opt-out signals as a request to opt out of targeted advertising and any sharing of personal data for that purpose, where required by applicable law.

We use the information described above to:

• respond to inquiries, prepare quotes and indications, and market, place, and service insurance coverage;
• submit applications and risk information to insurance carriers, wholesalers, and managing general agents on your behalf;
• verify information, assess eligibility, and support underwriting, premium audit, and claims processes;
• contact you by phone, text, email, or mail about your request, your policies, renewals, and other products and services that may be relevant to your business;
• operate, secure, troubleshoot, and improve the Site and our services, including through the analytics described in Section 4;
• measure and improve our marketing, and create de-identified or aggregated statistics that do not identify you; and
• comply with legal, regulatory, licensing, and recordkeeping obligations, and to establish, exercise, or defend legal claims.

We may disclose information:

• To insurance carriers, wholesalers, managing general agents, reinsurers, premium finance companies, and inspectors as needed to obtain quotes, place coverage, and service policies;
• To service providers that support our business — including hosting, analytics and session replay, spam and fraud prevention, email and messaging, CRM and agency management systems, e-signature, telephony, and professional advisors — who are permitted to use the information only to provide services to us;
• For legal and safety reasons — to comply with law, subpoenas, regulatory examinations, or lawful requests; to enforce our Terms of Use; or to protect the rights, property, or safety of TX Commercial, our clients, or others; and
• In a business transaction — in connection with a merger, acquisition, financing, reorganization, or sale of all or part of our business or assets.

Depending on where you live, you may have rights under the Texas Data Privacy and Security Act or similar state laws to: confirm whether we process your personal data and access it; correct inaccuracies; delete personal data you provided or we obtained; obtain a portable copy; and opt out of targeted advertising, sale of personal data, or certain profiling.

To exercise a right, email quotes@txcommercialinsurance.com or call 214-997-3888 with the subject line “Privacy Request.” We will verify your identity and your authority to make the request, and we will respond within the time required by applicable law. We will not discriminate against you for exercising these rights.

Certain information is exempt from deletion, including records we must retain under insurance, financial, tax, or other legal requirements, and information necessary to complete a transaction, detect fraud, or defend legal claims. If we decline a request, you may appeal by replying to our response with the word “Appeal.” If we deny your appeal, you may contact the Texas Attorney General to submit a complaint.

You may opt out of marketing email by using the unsubscribe link in any message, and out of text messages by replying STOP. We may continue to send transactional or servicing communications about quotes you requested or policies you hold. See Section 5 of the Terms of Use for the contact consent that applies when you submit a form.

We retain information for as long as needed to fulfill the purposes described in this Policy and to meet our legal, regulatory, insurance recordkeeping, and dispute-resolution obligations — which for insurance records is generally several years after a quote, policy term, or claim concludes. We may retain de-identified or aggregated data indefinitely.

We maintain reasonable administrative, technical, and physical safeguards designed to protect information against unauthorized access, use, and disclosure. However, no website, transmission method, or storage system is completely secure, and we cannot guarantee absolute security. You transmit information to us at your own risk, and email and web forms are not secure channels for sensitive personal information.

The Site may link to carrier portals and other third-party websites. We are not responsible for their content or privacy practices. Review their privacy policies before providing information.

The Site is intended for business use by adults. We do not knowingly collect personal information from anyone under 18. If we learn we have collected such information, we will delete it. Contact us if you believe a minor has provided information.

The Site is operated in the United States and intended for users located in the United States, and information is processed and stored in the United States. If you access the Site from elsewhere, you consent to the transfer and processing of your information in the United States, where privacy laws may differ from those in your jurisdiction.

We may update this Policy at any time by posting a revised version with a new “Last updated” date. Material changes will be indicated on this page. Your continued use of the Site after posting constitutes acceptance of the updated Policy.
